Steps to Take if you are Injured While at Work

June 19, 2011.

If you work in the Boston area and are injured on the job, you’re probably covered by Worker’s Compensation.  Will that be enough to protect you and your family from the aftermath of your injuries?  Sometimes it is, sometimes it isn’t.  In either case, there are certain steps you should follow to ensure that your rights are protected.  If you experience a workplace injury, here is what you need to do:

Get First Aid

This is the first and most important step.  First aid needs to be administered immediately.  If necessary, follow up with a medical provider for additional treatment or follow up care.  If the injury is serious or life threatening, emergency medical personnel should be called as quickly as possible.

Report the Injury to Your Employer

It is important that you report your injury to your employer as soon as you can.  The injury needs to be on record.  There are times when an employee does not suspect their injury is serious but suffers consequences at a later time.

Seek Medical Attention if Necessary

Do consult a physician or a chiropractor if necessary.  You may not require medical attention if the injury is minor, but it is appropriate for all other injuries.  You will need an adequate assessment and treatment plan created by a doctor or a chiropractor.  Consult with your employer to determine which medical practitioners are accepted to provide medical care for injured employees.

Complete Proper Injury Reports

Your employer should provide you with the necessary form(s) to fill out.  It is important that you complete the report in a timely manner in order to protect your rights as an injured worker.

Follow Medical Advice

You need to follow the recommendations of the treating physician and actively participate in your recovery.  If physical therapy is ordered, do it.  If you are given physical restrictions, adhere to them.  You are required to follow the recommended treatment plan to maintain your eligibility for benefits.

Sometimes the benefits and reimbursement from Workmen’s Compensation isn’t adequate, particularly if the injury was caused by negligence on the part of the employer.  If you live in the Boston area, and have suffered a workplace injury, you may wish to seek the advice of a Boston personal injury attorney.  There is no charge to discuss your case with a Boston personal injury lawyer, so don’t hesitate to contact one if it should become necessary.
